Refund Policy

This policy explains when Buildy (buildy.me) issues refunds for paid plans and AI usage, how to cancel, and the statutory rights you have as a consumer in the EU/EEA. It forms part of, and should be read with, our Terms of Service. “We” and “us” refer to Gonzalo Gomez, who operates Buildy as a sole trader (autónomo) in Spain.

01In short

  • Buildy is a digital service delivered instantly: every AI build spends compute that we pay for the moment it runs.
  • Credits you have already used are non-refundable.
  • You can cancel anytime; cancelling stops future renewals. The period you have already paid for is not refunded pro-rata, and your access continues until it ends.
  • EU/EEA consumers have a 14-day right of withdrawal — but if you ask us to start immediately and tick the consent box at checkout, you give that right up once we begin (see section 04).
  • If the service doesn't work as described, your statutory guarantee of conformity always applies — we fix it, reduce the price, or refund (section 05). These rights can never be waived.

02Subscriptions & billing

  • Paid plans (Pro €25/month, Max €50/month, Enterprise custom) are billed in advance through Paddle, our reseller and Merchant of Record, and renew automatically each month until you cancel. Prices are in euros; Paddle calculates and adds any applicable taxes (VAT/sales tax) at checkout based on your location.
  • Each plan includes a monthly allowance of AI “credits” (tokens) plus native-build credits. Allowances reset each billing cycle and do not roll over.
  • We will tell you the renewal price and date before you subscribe and before any price change, which only takes effect at your next renewal.

03Cancelling your subscription

  • You can cancel anytime from Settings → Billing (the Paddle customer portal). Cancellation is immediate to set up and confirmed by email.
  • Cancelling stops the next renewal. You keep access to your paid plan until the end of the period you have already paid for.
  • We do not refund the portion of a billing period that has already started once the service has been made available to you, except where the law requires it (sections 04 and 05).

04EU/EEA right of withdrawal (14 days) & immediate start

If you are a consumer resident in the EU/EEA, you normally have 14 calendar days to withdraw from a distance contract without giving a reason (arts. 102–104 of Spain's consumer law, Real Decreto Legislativo 1/2007, transposing Directive 2011/83/EU).

Because Buildy is a digital service that starts working immediately, at checkout we ask you to tick a separate box giving your express prior consent to begin straight away and acknowledging that you lose the right of withdrawal once we have started (arts. 103.a and 103.m). The wording you accept is:

“I expressly request and consent that Buildy begin supplying the service / digital content immediately, before the 14-day withdrawal period ends, and I acknowledge that I will lose my right of withdrawal once performance has begun.”
  • If you have not used any credits and are within 14 days, contact us and we will cancel and refund that payment in full.
  • If you have used some credits within the 14 days, you owe the proportionate value of what you used; we refund the rest (art. 108.3). Once the included allowance has been substantially used, no refund is due.
  • We confirm your contract and this consent on a durable medium (email). If you ever want the model withdrawal form, email hello@buildy.me.

05If the service doesn't work (statutory guarantee of conformity)

Independently of everything above, you have a mandatory legal guarantee that the service conforms to what we promised (arts. 114–126 of RDL 1/2007 as amended by RDL 7/2021, transposing Directive (EU) 2019/770). This right cannot be excluded or limited by this policy.

If Buildy is materially not as described — for example a sustained outage, or a verifiable platform fault that stops builds from working — we will first try to fix it, and where that isn't possible or fails, you are entitled to a proportionate price reduction or a refund for the affected period, paid without undue delay (and within 14 days of us confirming it). This does not cover dissatisfaction with the quality or style of AI output, unclear prompts, third-party service failures (e.g. Apple, Google, GitHub, Supabase), or usage stopped for safety or plan-limit reasons.

06Goodwill credit refunds (platform faults)

Beyond your statutory rights, if credits were spent on a build that failed because of a verifiable bug or malfunction on our side (e.g. an internal error, a broken tool, or the build stopping with no result), we will credit them back after we review the run. We may need read-only access to the relevant build to verify it, so please include the project and a description when you ask. Credits spent on builds that completed as expected are not refundable.

07Business customers (B2B)

The consumer rights in sections 04 and 05 apply only to consumers (natural persons acting outside a trade or profession). If you subscribe as a business — including another autónomo or a company contracting for its professional activity, identified by a CIF/NIF at checkout — those consumer-specific rights do not apply, and refunds are governed solely by your contract with us and this policy: subscriptions and used credits are non-refundable except for a verified fault on our side.

08How to request a refund

Because Paddle is the Merchant of Record, payments and refunds are processed by Paddle under Paddle's buyer terms and refund policy. You can request a refund or any billing help directly from Paddle (via the receipt/invoice email Paddle sends you, or its buyer support), and we'll also help.

  • Email hello@buildy.me from your account email, with your account, the plan or build concerned, and what happened — we'll review and, where due, ask Paddle to issue the refund.
  • Approved refunds go back to your original payment method via Paddle, typically within 5–10 business days depending on your bank.

09Changes to this policy

We may update this Refund Policy. We will post the new version with an updated date and, for material changes, take reasonable steps to notify you. Changes do not reduce rights you already have for a purchase already made.
